Will of Rachel Sheperd Bryan

Rachel Bryan's birth is estimated at abt. 1724. Her maiden name was Rachel Sheperd (Shepherd). She married Bennett Bryan and had 9 children living at the time of her husband's death in 1789. I believe Rachel' family also lived in Sussex County, DE because a map of the Sussex county in 1825 shows lots of Bennetts and Shepherd' s who owned adjoining property on the eastern part of the county. Nothing more is known about her family at this time. Below are the document which were included in her probate file.

To any Judge or Justice of the Peace for the County of Sussex. You are hereby required to Administer the Oath of Appraisor to Mesrs. Richard Hays and Radcliff Poyentor well and truly to appraise the goods and chattels which were of Rachel Bryan late of Sussex County decd so far forth as the same shall come to their sight or knowledge and to certify your compliance under your hand for which this shall be your sufficient warrant Witness my hand the 3rd day of Feb. 1791.

The Depososion of Rich Hays taken on oath this 3rd day of August 1791 is as folleth being on the road in company with Shepard Bryan some time in the year 17?? was requested to by the said Shepard to call at the house of Rachel Bryans ____ to snk at some corn he said he believed was taken out of his crub and going in to the house the said Shepard opened a doar of a closet which apeared to be 1/2 bushels of corn in the year which the said Shepard Bryan acqnsed the above said Rachel Bryan of taken out of his crub which charged the said Rachel at first denied but after some dispute on the matter she replied in there words "Well I don't cear I did take some for my Creatirs shall not starve" - further sayeth that the above said Shepard often times dare the aking to one and saying sombody he believed did take corn out of his crak-----

Sussex County To any lawful constable whereas as judgement passed against James Bryan one of the heirs of Bennett Bryan land and adm. of Rachel Bryan in favour of Avery Draper Collector for the Government tax for debt four shillings six pence and cost 10 shilligs nine pence before John T. Cambell on the 26th May 1792 you are there fore to levy as much of the goods and effects of the said James Bryan a will discharge said debt 16 cost 3/9 ??? interest and accruing cost and proceeds the law directs given under my hand and seal this 13 th day of August 1792

You are therefore to levy as much of the goods and chattles of the said James Bryan as will discharge the above debt 19 shillings _ cost 3/9 __ interest on the same thru ____ acruing and proceed as the law directs given under my hand and Seal this 13th day of August 1792.

Campbell one of the justices of the County of Sussex faithfully and impartially to and it the accounts of both parties aforesaid and a true report there of to make according to our evidence provided by order of the said John T. Campbell justice of the pease aforesaid to hear examine the allegations and proof of the said Plaintiff and the said defendant of and dow upon on our oath say we find for the Plaintiff the sum of t__ pounds three shillings and seven pence with cost of suit given under our hands and seal this day of December 1791.
